Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and CheerHit ("we", "us", or "our") governing your access to and use of the CheerHit website, web dashboard, and mobile app at https://www.cheerhit.com (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

Description of Service

CheerHit is an operating system for cheerleading clubs, and it serves two kinds of people.

Clubs use the web dashboard to manage their teams, rosters, schedules, competitions and attendance. Athletes use the mobile app to hold their own athlete profile, join a club, see their schedule and confirm whether they are coming to each session.

Club plans are paid. Athlete accounts are free.

Eligibility

You must be at least 18 years of age to create an account for yourself and to accept these Terms.

An athlete under 18 may hold an athlete account, but that account must be created and operated by a parent or legal guardian, who accepts these Terms on the athlete's behalf and remains responsible for the use of the account. Where an athlete is old enough to manage their own account under the law of their country, and their parent or guardian agrees, the account may be handed over to the athlete.

By using the Service you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms.

Account Registration

To access the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Athlete Accounts and Guardians

Every athlete on CheerHit has their own account, held in the athlete's own name. That is how the athlete appears on the roster, the schedule and the attendance record.

Where the athlete is a minor, the parent or guardian is the person operating that account: they create it, they hold the credentials, they receive the emails sent to it, and they accept these Terms. The account still carries the athlete's name, because it is the athlete who is on the team.

If you operate an account on behalf of a minor athlete, you confirm that you are their parent or legal guardian, or that you have their parent or guardian's authority to do so.

Club and Member Data

The Service allows a club's owners, administrators and coaches to enter and manage information about their club's members and athletes, some of whom are minors. If you hold one of those roles, you are responsible for the accuracy of that information and for obtaining all consents required (including parental or guardian consent for minors) before entering an individual's information into the Service. You agree that you have the authority to provide this information and that doing so does not violate the rights of any person or any applicable law.

Subscription and Payments

Subscription Plans

Club plans are paid, and are priced per team. Current pricing is displayed on our pricing page. Prices may be subject to change, and any changes will be communicated to you in advance. Athlete accounts are free and will remain free.

Free Trial

We offer a 14-day free trial to new clubs. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

Auto-Renewal

All subscriptions automatically renew at the end of each billing period unless you cancel your subscription before the renewal date. You can manage and cancel your subscription through your account settings.

Payment Processing

Payments made through our website are processed by our third-party payment processor, Stripe, and are also subject to Stripe's terms and conditions. Where a subscription is purchased inside a mobile app, the purchase is processed by the relevant app store under that store's own terms, and you manage or cancel it in your app store account settings rather than with us.

Refunds

The 14-day free trial is your opportunity to evaluate the Service. Once a subscription charge has been made, payments are generally non-refundable, except where required by applicable law. You may cancel at any time through your account settings to avoid future charges. If you believe you have been charged in error, please contact us at contact@cheerhit.com. Purchases made through an app store are refunded by that store under its own policy.

User Content and Data

You may create and store content within the Service, such as your athlete profile and profile photo, your club's crest and details, rosters, teams, schedules, competitions, check-in records and the reasons given for missing a session. You retain ownership of any content you create. By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the Service to you.

You are responsible for the content you upload. By uploading an image, including a profile photo or a club crest, you confirm that you hold the rights to it or have permission to use it, and that displaying it through the Service does not infringe anyone's rights.

If you cancel your subscription or delete your account, your data will be retained for 30 days and then permanently deleted. During this retention period, you may contact us to request a copy of your data.

Intellectual Property

The Service, including its original content, features, and functionality, is owned by CheerHit and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Limitation of Liability

To the maximum extent permitted by applicable law, CheerHit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

Indemnification

You agree to indemnify, defend, and hold harmless CheerHit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time through your account settings.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service prior to the changes becoming effective. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the competent courts of France.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
